When a legal matter arises, most people seek legal representation from a licensed attorney well- versed in the area of law that addresses their problem. But there are no laws against pursuing a matter without an attorney, and not all matters actually require professional guidance.    Here are 5 reasons why you may not even need an attorney:

1. You proceed Pro Per or Pro Se. These latin terms mean that one is advocating on one’s own behalf before a court, rather than being represented by a lawyer. If you feel confident that you can educate yourself about the relevant area of law that concerns you, then perhaps you could represent yourself in either civil or criminal court. When proceeding “pro se”, you will be held accountable for adhering to the court procedures and decorum in the applicable jurisdiction. Your tasks will include conducting proper legal analysis, preparing and writing proper legal pleadings and conducting the legal research and discovery necessary to prevail in your matter. You will still be responsible for filing fees, fees for depositions and other items related to handling your matter. If you are not sure what “discovery” involves…look it up! There’s no better time to start your pro se status than the present.

2. You hire a paralegal. A paralegal is a good person to seek help from if you have a matter that requires a lot of standard forms to complete. For instance, in a bankruptcy or a probate matter, the paralegal is limited to advising their client with filling in the answers to the legal questionnaires. A paralegal is similar to a physician assistant for a doctor. They are trained professionals who are legally limited to perform certain tasks. Like a real estate agent, or financial adviser, a paralegal cannot provide legal advice and can lose their license if they do so.

3 Your matter could be heard in Small Claims Court. In a small claims matter only the actual parties can represent themselves in civil matters. In most jurisdictions, the amount of the controversy is limited and ranges from 00 to 00 dollars. If you have seen Judge Judy, Okra, Kevin, or Evelyn on T.V., then you already have an idea of the less formal and more simple procedures found in a small claims court, with hopefully much less drama. But the small claims court is a great venue for people to seek redress and receive a binding judgment. When considering the costs and benefits of using an attorney, sometimes it’s best to pursue the maximum amount in a small claims action even if it doesn’t satisfy the total balance of the amount disputed.    

4. You consider mediation. There is a recent trend in the law known as “alternative dispute resolution.” In an attempt to save on costly litigation lay people and companies will often go to one attorney for assistance even though the parties may have opposing interests. While an attorney can represent both sides with proper written disclosures, the parties that I have known to use one attorney, leave unhappy. A more cost effective alternative is to use a trained mediator. A mediator is usually an attorney who is well versed in the law. They are supposed to be impartial, and depending on what the parties to mediation agree, the mediators opinion can be binding. Even if the parties choose not to have a binding decision, a mediator’s analysis is often a good indication of what outcome one can expect in a court of law.    

5. You have time and the fortitude.    Pursuing or defending a legal matter can be exhausting, both financially and emotionally, and this is usually when one retains an attorney. So consider the best use of your time. Could you be earning more investing your time into your own work instead of taking on larger and less familiar tasks? Do you have the emotional fortitude to withstand professional assaults on the integrity of your position? If you have the time and an iron stomach then you should consider pursuing your own claim.

Having an attorney is similar to hiring a real estate agent. In a real estate deal, one can sell their own home and save substantially on a sales commission. But the benefit of having a real estate agent is more than just about commission or having someone sticking a sign on your lawn or place a lock box on your door. A good agent performs so many administrative tasks behind the scenes. But most importantly, the agent acts as a professional buffer between a buyer and a seller. Not everyone has the emotional constitution to deal with criticism or unhappiness surrounding the sale or purchase of a their home. The real estate agent takes on the burden of softening the emotional blows and focusing on all the “working parts” needed to move a deal forward. That is what an attorney does for their clients, but on a higher level of the risk – reward equation.

Conclusion. There are times when using an attorney may not be necessary. But try not to cite “money” as the reason to forgo proper legal representation since there are different types of affordable fee arrangements that attorneys can structure for clients. If you are ever in doubt of your legal rights, absolutely no one but a licensed attorney (practicing in the area of law that concerns you) can advise you of your legal rights and remedies.) Attorneys, like most professionals, can briefly give you time to discuss and assess your matter and advise you accordingly. Only then should the options enumerated above be considered.

In keeping with my recent articles on anti-aging and skin care basics, I realized it was also important to talk about which vitamins, minerals and nutrients you can take for great skin. What’s really terrific is when your skin is healthy, it’s likely that the rest of you will be, too. In Part 1 of this article, I’ll talk about which vitamins will make you look and feel great. In Part 2, I’ll talk about which nutrients you can apply topically for beautiful, glowing skin.

 

Keep in mind that many of these nutrients are available in the foods you eat, particularly if you eat a balanced diet of colorful foods such as green leafy vegetables, fruits in season, whole grains, lean meats and fish.

 

You’ll notice that many of the vitamins and minerals I list aid your skin and body because they’re potent antioxidants – chemicals that fight the tendency for oxygen-containing free radicals to harm our cells and DNA.

 

Vitamin C is one of the most common supplements we take, for good reason. We even use its antioxidant properties in the kitchen. Want to keep a cut apple from turning brown in the air? Coat it with a little vitamin C-rich citrus juice. This same action also keeps your cells and DNA from breaking down when exposed to free-radical forming agents such as cigarette smoke and sunlight. Take up to 1,000 mg per day as a supplement, or add more citrus and green vegetables to your diet to make sure you’re getting the maximum benefit from vitamin C.

 

Vitamin E is another potent antioxidant that works at combating free radicals in your skin and throughout your body. While it’s safe to take in doses of up to 400 IU per day, usually the amount of vitamin E in your multivitamin will be adequate.

 

Folic acid is beneficial in supporting cell division and DNA production, both of which can protect your skin cells. Making sure you take at least 400 micrograms per day can help prevent skin diseases, certain forms of cancer and anemia.

 

Carotenoids including beta-carotene, lycopene and lutein all function as antioxidants. Find these colorful nutrients in supplement form or just add extra red, yellow and orange foods to your diet to tap into their damage-fighting mojo. Beta carotene is a precursor of vitamin A, another vitamin antioxidant which has been shown to fight the signs of aging, especially when vitamin A is applied topically in the form of Retin-A. (More on that in Part 2 of this article.)

 

Selenium, zinc and copper are all important to your skin’s health for different reasons. Selenium is a potent antioxidant, zinc controls oil production and, along with copper, is important in the formation of skin-supporting elastin. Each of these minerals will usually show up in adequate supplies in a diet rich in nuts, meat and grains, and in your multivitamin, so don’t worry about taking extra supplements.

 

Fish oil is a supplement you may already be taking for its ability to protect your heart and nervous system. The good news is that according to a scientific study published in 2005, one of its Omega-3 fatty acids, EPA, also fights sun damage and reduces wrinkles.

 

Hyaluronic acid, the same compound that’s found in our skin and in the cosmetic fillers Restylane® and Juvederm®, is available to take in supplement form. Taken orally, its water-binding nature can fill out skin for a more beautiful appearance.

In Part 1 of this article, I discussed a handful of vitamins and nutrients that you can take internally to benefit your skin. You can also “feed” your skin by applying biologically-active vitamins and nutrients topically. Here are eight vitamins, minerals and nutrients you can apply to your skin for anti-aging skin care — to achieve a more youthful, vibrant appearance.

 

Please note there are many products on the market that contain the following ingredients. I personally favor cosmeceuticals — skin care products that contain the purest pharmaceutical-grade biological actives. While this article isn’t a product review, if you need help deciding which products to buy, I encourage you to contact my office (see my information at the bottom of this article).

 

REPAIR IT

 

Vitamin C, available without a prescription, has emerged as the wunderkind of topical skin repair agents. Its antioxidant action is clinically-proven to reverse damage caused by free radicals while also stimulating collagen growth. This is a good thing.  More collagen equals visibly younger-looking skin. One caveat: vitamin C preparations are notoriously unstable, and can actually cause free-radical damage once they degrade.  Therefore, make sure to store your vitamin C cream or other preparation in a cool dark place and discard if the color changes. An anhydrous (non-water containing) vitamin C cream, or one that also contains ferulic acid, enhances the vitamin’s stability.

 

Retin A, also known as tretinoin, is a form of vitamin A available by prescription. A tretinoin cream works in a variety of ways to reduce the appearance of wrinkles and to minimize the signs of aging.  Some of these ways include increasing the skin’s thickness, regulating oil production, stimulating collagen production, and even possibly turning back the aging clock of skin cells. Take care with using Retin A, though, as some people develop local irritation when using it.

 

Copper peptides are absorbed deep into the dermis, where they’re effective in stimulating the skin to heal and repair itself. The result is increased collagen production and decreased wrinkles. A copper peptide product is also good to use following the exfoliant use of alpha hydroxy acids and Retin A to promote optimal healing and repair.

 

CoEnzyme Q10 levels diminish in the skin as we age. A cream containing this vitamin-like compound increases your cells’ ability to produce energy. The likely outcome for users of topical CoEnzyme Q10 is diminished wrinkles, improved texture and increased elasticity — in other words, better, younger skin.

 

HYDRATE IT

 

Hyaluronic Acid, which also diminishes in our skin through aging, attracts many times its weight in water. A moisturizer containing hyaluronic acid can “plump” skin, filling fine lines for a noticeably younger appearance. One note: in dry climates, the hyaluronic acid may try to pull water from the skin instead of the air. Be on the lookout for drier skin, and increase your moisturizer use accordingly.

 

SMOOTH AND EVEN IT OUT

 

Alpha hydroxy acids, present in many moisturizers, are clinically-proven to reduce the appearance of wrinkles and to even out skin tone. Look for preparations that contain at least eight percent AHA but that don’t exceed 15 percent (at least not without the supervision of your dermatologist).

 

Niacin A was featured in a recent 12-week study, and showed that a five-percent niacin preparation reduced fine lines and wrinkles, faded extra pigmentation and blotchiness, and smoothed rough skin. A bonus: this topical vitamin is very safe and easy to use.

 

Vitamin K is a vital component of the blood’s clotting factors. Along with a diet rich in vitamin K or a supplement, a vitamin K cream can be applied topically to reduce dark under eye circles.

 

With a practical routine of repair, hydration and smoothening, a vibrant, youthful appearance is close at hand when you “feed” your skin with biologically active vitamins and nutrients.

In my medical practice, whenever I begin to talk about Vitamins & Minerals, most people ask “What are Vitamins and/or Minerals, do I need them and what is the best way to get them?”

I begin by explaining that the human body requires certain essential vitamins and minerals to be introduced, usually through food, into the body on a daily basis.

The only problem with this is that our modern day farming techniques can and often does remove an amount of those essential vitamins and minerals. A government study done over seventy years ago warned us that our soils were depleted of many of the necessary nutrients (vitamins and minerals), which means if the nutrients aren’t in the soil, how do you expect them to be in your fruits & vegetables? Modern farmers use fertilizers that speed the growing process, but these fertilizers lack many of the nutrients that need to be in the soil. Than there is the processing of the produce that can remove even more of the vital nutrients. So what are we to do?

The answer is very simple. You need to supplement your diet with a Whole Food Supplement. I do not mean an off the counter, at your grocery store, vitamin and/or mineral, I mean a True Whole Food Supplement. There is a very big difference between the two.

By definition (From Wikipedia, the free encyclopedia), whole food supplements are foods that have been compressed into tablet form, poured into capsules or powdered. The word “whole” indicates that the end product — a supplement — does not contain parts of foods, or synthetic or isolated vitamins. Ideally, the foods comprising these supplements have not been subjected to irradiation, contain no pesticide or herbicide residues, contain no GMO (genetically modified organisms), have not been sterilized, and do not contain animal products that have been subjected to steroids, antibiotics or other drugs. The belief being, the closer to nature, the more benefit foods provide the consumer.

Further, whole food supplements should not contain isolated minerals, amino acids, carotenes or any other substance that is not native to, and still intact within, the original food. Thus, a supplement that contains foods plus a mixture of isolated (also called “fractionated”) vitamins, minerals, amino acids and other substances, does not constitute a whole food supplement. Examples of whole food supplement ingredients may include carrots, broccoli, kale, alfalfa, wheat grass, acerola cherry, cauliflower, kelp, wild pansy, spirulina, bovine liver, bovine kidney, radishes and quinoa.

As for your typical over the counter multi-vitamin/mineral, as Mercola.com puts it, please don’t make the mistake of shopping for supplements at discount stores or large chains like Wal-Mart or Walgreen’s. In my opinion, these are examples of companies that primarily use cheap synthetic ingredients.

Synthetic alternatives to whole foods are known as “isolates”. Your body will absorb only a small percentage of an isolate form of vitamins and minerals and utilize even less. On top of that, there could potentially be side effects, depending on the quality of the isolate.

Many retail outlets and online sellers are primarily interested in your money, not your health. Supplements are not their specialty. Always refer to medical practitioners who specialize in Health & Wellness, for your nutritional questions.

You wouldn’t go to your local Fast Food Restaurant for a nice steak, would you? The same attitude should apply to your health products. You will get what you pay for, so buyers beware.

Consider this when choosing a supplement:

• If the ingredients were all natural, it would say so on their label.

• If the product went through vigorous quality control, you can bet that it would be mentioned.

• If there were no additives or major potential allergens in the product, they would definitely tell you all about it.

Additionally, the ingredients many companies use are not only synthetic, but there is a likelihood they may not have been thoroughly tested for purity and potency.
